“OLG Suite Experiential Event – Blue Jays Gift”

INTRODUCTION

  1. 1. The “OLG Suite Experiential Event – Toronto Blue Jays – 2025 Season” (the “Promotion”) is governed by these Promotion Specific Terms (these “Promotion Specific Terms”) and is sponsored by the Ontario Lottery and Gaming Corporation (“OLG”).
  2. 2. This Promotion is made up of a series of twenty (20) individual promotions named “Toronto Blue Jays OLG Suite Experience”, each with a discrete entry period as communicated by OLG in its sole discretion, and each comprising six (16) Gifts which include one (1) pair of tickets to attend a specific Toronto Blue Jays home game in the 2025 season as further detailed below (“Individual Promotion”). Individual Promotions will be available on discrete dates between March 6th, 2025, and September 4th, 2025 (“Promotion Period”). For clarity, by opting-in to any Individual Promotion in accordance with Section 16, a Player, Prospective Player, Intending Player, or any other user (as applicable) (all the foregoing, hereinafter an “Individual”) is confirming that they understand, accept, and agree to be bound by these Promotion Specific Terms which govern each Individual Promotion. Eligible Participants are only eligible to participate in the specific Individual Promotion that they are selected for and have opted-in to in accordance with these rules, and within the timelines communicated by OLG.
  3. 3. This Promotion, and each Individual Promotion is subject to the General Terms and conditions which may be found here. The General Terms are hereby incorporated into and form part of these Promotion Specific Terms. OLG may revise the Promotion Specific Terms from time to time and in such a manner as OLG, acting in its sole discretion, determines to be appropriate. Any conflict or inconsistency between these Promotion Specific Terms and the General Terms shall be resolved in accordance with the General Terms. Any capitalized terms not otherwise defined herein shall have the meaning ascribed to them in the General Terms.
  4. 4. OLG may disclose the personal contact information associated with a Gift Recipient’s Player Account to third parties, which may include any agency responsible for gift fulfillment, for the purpose of providing the Gift to the Gift Recipient.
  5. 5. If an Individual does not agree with these Promotion Specific Terms or the General Terms, they must not opt-in to the Promotion.
  6. 6. This Promotion is intended to be conducted separately and with a distinct set of Promotion Specific Terms from all other promotions being administered by OLG.

PROMOTION ELIGIBILITY

  1. 7. Each Individual Promotion is available in Ontario only and to residents of Ontario who:
    1. are nineteen (19) years of age or older at the time of participation;
    2. have a valid Player Account that is in good standing in accordance with the Player Agreement and has not been archived, self-excluded or deactivated from the time of participation through to the date the Gift Recipient receives the two Blue Jays Tickets; and
    3. have been selected to participate in this Promotion and are otherwise qualified and not precluded from participating in OLG marketing and promotions, including the Promotion, based on the application of OLG’s current policies at the time of the Promotion, including OLG’s responsible gambling policy (“Eligible Participant”). Without limiting the foregoing, an Individual will not be eligible to participate in this Promotion if that Individual is rated as high risk under 3.10 of the Responsible Gambling and My PlayBreak Policy at or before the time of the Individual’s opt-in, regardless of whether that Individual received an invitation to participate in this Promotion.

    Volunteers, employees, officers, and directors of OLG, any of OLG’s advertising, promotion and contest management agencies, the Alcohol and Gaming Commission of Ontario (“AGCO”), and their respective subsidiaries, affiliates, shareholders, members, officers, directors, agents, representatives and employees are not eligible to participate in this Promotion.

  2. 8. In the event that an Individual does not meet the eligibility requirements as set-forth herein, OLG has the right, in its sole discretion, to reject or disqualify the Individual from participating in any Individual Promotion. The disqualified Individual will not be entitled to any substitute benefit or any other form of compensation due to such disqualification.

PROMOTION PERIOD

  1. 9. An Individual Promotion will be presented to Eligible Participants via the “Promotions Lobby” webpage of their Player Account within the Promotion Period. It will be made available at 6:00 PM EST on the Thursday of the third (3rd) week prior to the date of the Event being offered for each Individual Promotion (the “Individual Promotion Start”). The Individual Promotion will be available and redeemable from the Individual Promotion Start until 11:59 PM EST on the fourteenth (14th) calendar day from each Individual Promotion Start (each, “Individual Promotion Period”).

GIFTS

  1. 10. There are a total of sixteen (16) gifts available for each Individual Promotion as described below (individually, a “Gift”, and collectively, the “Gifts”), which will be available on a FIRST COME FIRST SERVE BASIS.

    3. One (1) Visa Gift Card valued at two hundred and fifty Canadian dollars ($250.00 CAD) per person (total of 2) to reimburse the Gift Recipient and their guest’s transportation costs to and from the Event and for merchandise.

  2. Gifts include only those elements described in Section 10. Gifts (and any components or elements thereof) may not be separated and none of its components are eligible for upgrades or loyalty points or rewards.

  3. IMPORTANT NOTE: THE DETAILS ASSOCIATED WITH THE EVENT BEING OFFERED AS PART OF EACH INDIVIDUAL PROMOTION, INCLUDING BUT NOT LIMITED TO VENUE LOCATION, OPPONENT, AND TIMING OF EVENT WILL BE PRESENTED ON THE INFORMATIONAL LANDING PAGE OF THE PROMOTION: (I) ACCESSIBLE PRIOR TO OPT-IN THROUGH THE APPLICABLE BANNER AD OR IN THE PROMOTION LOBBY OF AN ELIGIBLE PARTICIPANTS’ PLAYER ACCOUNT; OR (II) FOUND WITHIN THE CONFIRMATION EMAIL SENT TO ELIGIBLE PARTICIPANTS AFTER THEY OPTIN.

  4. 11. Gifts are non-transferable and non-assignable and can only be redeemed by an Eligible Participant. Gifts must be accepted as awarded.
  5. 12. Gifts and Gift components are subject to change. In the event an Eligible Participant is unable to themselves make use of any component of a Gift in accordance with the Promotion Specific Terms, they may lose any entitlement to the Gift or any substitute prize or benefit and OLG reserves the right, in its sole and absolute discretion, to designate a new Eligible Participant.

SELECTION PROCESS

  1. 13. For each Individual Promotion, OLG will select, in its sole and absolute discretion, sixteen (16) Eligible Participants to receive a Gift. If an Eligible Participant is disqualified from an Individual Promotion, they shall lose their entitlement to a Gift and OLG may in its sole and absolute discretion select another Eligible Participant to whom a Gift will be offered. OLG may continue this process until all Gifts have been redeemed.
  2. 14. GIFTS IN RESPECT OF AN INDIVIDUAL PROMOTION WILL BE AWARDED TO ELIGIBLE PARTICIPANTS ON A FIRST COME, FIRST SERVED BASIS IN THE ORDER IN WHICH EACH ELIGIBLE PARTICIPANT HAS OPTED-IN TO AN INDIVIDUAL PROMOTION IN ACCORDANCE WITH SECTION 16. FOR CERTAINTY, ELIGIBLE PARTICIPANTS WILL NOT BE ENTITLED TO A GIFT IN RESPECT OF AN INDIVIDUAL PROMOTION IF THEY ARE NOT ONE OF THE FIRST SIXTEEN (16) ELIGIBLE PARTICIPANTS TO OPT-IN TO AN ELIGIBLE PROMOTION.

GIFT REDEMPTION AND FULLFILMENT

  1. 15. For the purpose of these Promotion Specific Terms, a “Gift Recipient” is an Eligible Participant that has not been disqualified pursuant to these Promotion Specific Terms and redeems a Gift by opting-in to the specific Individual Promotion and communicating their agreement to these Promotion Specific Terms in accordance with Section 16 within the timelines prescribed by OLG.
  2. 16. In order to be considered for the Gift, the Eligible Participant must opt-in to the specific Individual Promotion and communicate their agreement to these Promotion Specific Terms during the Promotion Period, using either of the following methods:
    1. Log-in to their Player Account, navigate to the “Promotions Lobby”, and select the “Opt-In” button for the “OLG Suite Experiential Event – Toronto Blue Jays Gift” Promotion; or
    2. Log-in to their Player Account, navigate to the “Promotion Details Page” for “OLG Suite Experiential Event – Toronto Blue Jays Gift” Promotion from the promotional banners/emails and select “Opt-In” button on the Promotion details page.
  3. 17. To redeem a Gift, an Eligible Participant may be required to present a valid government-issued photo identification. If the Eligible Participants fail to do so, the applicable Gift may not be awarded and OLG will have no obligation to award any substitute gifts or rewards.
  4. 18. A Gift will be awarded to a Gift Recipient as follows:
    1. After opt-in in accordance with Section 16, the Gift Recipient will receive two (2) Toronto Blue Jays tickets delivered to the email address associated with their OLG Player Account. The details of the Event will be available to the Eligible Participant on the Promotion Details Page in the Promotions Lobby prior to opting in. OLG will endeavor to deliver the tickets around three to six days prior to the date of the Event being offered as part of the Individual Promotion. By way of example only, if an Eligible Participant has opted-in to an Individual Promotion with the Event taking place on March 29th, 2025, OLG will endeavor to provide the Gift Recipient two (2) Toronto Blue Jays tickets between March 22nd, 2025 to March 29th, 2025.
    2. On the date and time of the Event being offered as part of an Individual Promotion, OLG or one of its designates will provide the remaining Gift components (excluding the Toronto Blue Jays Tickets) to the Gift Recipient and guest at Gate 3 of the Rogers Centre and in-suite.
  5. 19. If an Eligible Participant does not meet the requirements of Sections 16 and 17, the Eligible Participant shall no longer be entitled to a Gift (or any substitute or other form of compensation) and OLG may in its sole and absolute discretion offer the Gift to another Eligible Participant.
  6. 20. No substitutions or equivalent cash payments will be made for any Gift, save for OLG’s right, at its sole discretion, to make substitutions of equivalent or greater value. Except as specifically provided herein, unclaimed Gifts will not be awarded.
  7. 21. There is a limit of one (1) Gift per Gift Recipient per Individual Promotion. In no event will an Eligible Participant be eligible to receive more than one (1) Gift in any Individual Promotion.
  8. 22. If it is discovered by OLG (using any evidence or other information made available to or otherwise discovered by OLG) that any Eligible Participant (or any person or entity purporting to be an Eligible Participant) has attempted to: (i) redeem more than one (1) Gift; and/or (ii) use multiple names, identities, email addresses and/or any automated, macro, script, robotic or other system(s) or program(s) to enter or otherwise participate in or to disrupt this Promotion; then he/she may be disqualified from participating in the Promotion in the sole and absolute discretion of OLG and OLG will have no obligation to award the Gift in relation to that Eligible Participant.
  9. 23. If the Eligible Participant no longer wishes to participate in a specific Individual Promotion after completing the steps set out in either Section 16 (a) or (b), they must opt-out from the Individual Promotion via the “Promotion Lobby” page of their Player Account or contact a OLG Host through the “Contact Us” page or by calling 1-800-387-0098. After opting out, the Eligible Participant agrees that they will no longer be eligible to receive the Gift or any component thereof and OLG may in its sole and absolute discretion offer the Gift to another Eligible Participant.

GIFT RECIPIENT RESPONSIBILITIES

  1. 24. Guest Selection. A Gift Recipient of a Gift may have a guest accompany the Gift Recipient attend the Event for which they received tickets as part of the redemption of their Gift. Such guest must, at the time of attending the Event, be 19 years of age or older. In respect of any guest attending the Event with the Eligible Participant, the Eligible Participant agrees to comply with all relevant provisions of the Promotion Specific Terms as they pertain to their guest’s attendance, and further agree to be solely responsible for any acts or omissions of said guest. The Gift Recipient’s guest may be asked to show proof of age before or during the Event.
  2. 25. Third Party Terms. The Eligible Participant understands and acknowledges that each component of the Gift and the use thereof may be subject to a separate set of third-party terms and conditions, including but not limited to rules, regulations, restrictions, terms and conditions indicated on any tickets associated with the Gift, in force at the venue hosting the Event, and any health and safety polices or protocols associated with any of the foregoing (e.g., COVID-19 testing requirements, vaccination requirements and proof, social distancing requirements, requirements for face coverings, etc.) (“Third Party Terms”). The Gift Recipient is responsible for determining the Third-Party Terms applicable to the Gift (or component thereof) and their use thereof and hereby agrees to comply with such applicable Third-Party Terms. OLG, Rogers Blue Jays Baseball Partnership, Rogers Sports Holdings Inc. and their respective affiliates, owners, shareholders, officers, directors, agents, representatives, employees, successors and assigns (collectively the “Released Parties”) do not make, and expressly disclaim, any representations or warranties with respect to any Gift component and expressly disclaim any responsibility or liability to a Gift Recipient for any Gift component. The Gift Recipient and guest are solely responsible for complying with Third Party Terms; failure to do so may result in forfeiture of the Gift.
  3. 26. Expenses and Transportation. Any and all expenses or other requirements associated with the Gift not expressly provided for herein are the sole responsibility of the Gift Recipient. The Gift Recipient is responsible for arranging transportation for themselves and their guest to and from the location of the Event.
  4. 27. Sale of Event tickets. The Gift Recipient will not sell, trade or transfer their two (2) admission tickets for the Event or any other Gift or Gift Component.
  5. 28. E-Mail Communication. The Gift Recipient agrees to receive email communication from OLG or its Third Party Promotion Agency regarding information about the Gift (such as Event details), as well as a link to a post Event survey. Event details include (but are not limited to) Event confirmation details, Event venue information, Event reminders, Actual Event Tickets and waitlist information.
  6. 29. Third Party Promotion Agency. By entering this Promotion, the Eligible Participant consents to the collection, use and distribution of their personal information (including, but not limited to their full name and email address) by the promotion agency designated by OLG to implement, administer and fulfill this Promotion (the “Promotion Agency”).

GENERAL TERMS

  1. 30. Disclaimer. The Released Parties will have no responsibility whatsoever in respect of any claim arising in connection with the participation in the Promotion, any Individual Promotion, or any Gift awarded. Rogers Communications Canada Inc. Rogers Blue Jays Baseball Partnership have not offered or sponsored the Promotion in any way.
  2. 31. COVID-19. Furthermore, the Eligible Participant acknowledges, understands, and agrees that there is an inherent risk of exposure to COVID-19 at any place where people gather. COVID-19 is an extremely contagious disease that can lead to severe illness and death. The Eligible Participant assumes all risks, hazards, and dangers arising from or relating in any way to the risk of contracting a communicable disease or illness—including, without limitation, exposure to COVID-19, and regardless of how caused or contracted—and the Eligible Participant hereby waives all claims and potential claims against OLG relating to such risks, hazards, and dangers.
  3. 32. Force Majeure. In the event a Gift (or any component or element thereof) cannot be awarded as contemplated by the Promotion Specific Terms due to circumstances outside of the reasonable control of OLG, including but not limited to an act of God, acts or policies of any federal, regional or municipal governmental authority (domestic or foreign), strikes, lockouts, pandemic, fires, floods, earthquake, storm, or epidemic, OLG shall not be in breach of the Promotion Specific Terms and, as applicable, may, in its discretion, without providing prior notice to the Eligible Participant or Gift Recipient, as applicable, and without incurring penalty or liability:
    1. provide an altered or modified Gift (or any component or element thereof) to the Gift Recipient as OLG deems necessary; or
    2. substitute the Gift (or any component or element thereof) with a prize (or any component or element thereof) of equal or greater approximate retail value.
  4. 33. Eligible Participants hereby agree to release, indemnify, and hold harmless forever the Released Parties from and against any and all claims, losses, damages, liabilities and costs and expenses (including reasonable legal fees) which may arise from, or in relation to:
    1. the Eligible Participant’s participation in this Promotion;
    2. any breach by the Eligible Participant of any covenants, agreements, terms, obligations, representations, or warranties set forth herein; and

    the acceptance, receipt, possession, use, misuse or non-use of the Gift or any component thereof by the Eligible Participant.

  5. 34. The decisions of OLG with respect to all aspects of this Promotion are final and binding without review or right of appeal. By participating in this Promotion, each Participant is agreeing to be legally bound by these Promotion Specific Terms. ANYONE DEEMED BY OLG TO BE IN VIOLATION OF THESE TERMS FOR ANY REASON IS SUBJECT TO DISQUALIFICATION IN THE SOLE AND ABSOLUTE DISCRETION OF OLG AT ANY TIME.
  6. 35. Headings in these Promotion Specific Terms are for convenience purpose only and do not affect the interpretation of the Promotion Specific Terms contained herein.
